LIMITED WARRANTY OF DIAS Customs Ltd – Electric Mobility Sector (VAT NO. CY30013285Q, COMPANY REGISTRATION NO. HE449214, Tel: 99819787)
This limited warranty is extended to the consumer of DIAS Customs Ltd electric mobility products (“the Client”). It does not exclude nor limit any rights of the Client that are mandatory under the law.
The duration of the guarantee is 24 months, and under no circumstances shorter than 24 months, valid from the date of purchase of the product by the client. If the product is replaced, the warranty duration shall continue for the remaining part of the 24-month period starting from the purchase invoice date.
During the warranty period, DIAS Customs Ltd will repair for free, replace the defective product for free, or terminate the agreement according to law N.154(I) 2021, provided that the notification of the product defect is made within 2 months from the occurrence, at its sole discretion.
DIAS Customs Ltd will return the repaired or replaced product to the client in working condition. If a defective part is being repaired, the component shall be changed. All replaced components or other equipment become the property of DIAS Customs Ltd.
This limited warranty does not apply to natural wear and tear. It also does not apply if:
- The defect was caused by the product’s use not conforming to the manufacturer’s instructions: abuse, exposure to extreme conditions, non-authorized modifications, non-authorized opening or repair, misuse, unsuitable installation, accident, or natural phenomena beyond the reasonable control of DIAS Customs Ltd.
- The product serial number, identifying date code, or IMEI number has been removed, deleted, defaced, altered, or is illegible.
- The defect was caused by a defective network operation.
- The defect was caused by using the product with a computer not compatible with its technical specifications.
- The product software requires upgrading due to modifications in the network parameters or modifications of the product software by a non-authorized person.
- The defect is due to a file or program installed in the internal or external memory of the appliance.
- The product has not been checked by the technical department of DIAS Customs Ltd to establish and verify the defect.
The limited warranty is valid only if the client presents the original product purchase receipt and delivers the product to DIAS Customs Ltd.
This limited warranty is the sole and exclusive means for customer satisfaction according to DIAS Customs Ltd and the sole and exclusive liability of DIAS Customs Ltd against the client for defects or malfunction of the product. This limited warranty substitutes all other guarantees and obligations, either verbal, written (non-mandatory) by law, conventional, malfeasance, or others. DIAS Customs Ltd will not, under any circumstances, be liable for direct damage, costs, or expenses if the client is a legal person.
Any modification or amendment to this limited warranty requires the prior written consent of DIAS Customs Ltd.
For any problems not referred to above, the company shall not be liable for their repair. The company is only liable to inform the client and to request consent for additional charges. If any product is deemed out of its warranty period due to the above reasons, then the fault is not regarded as being factory or manufacturer-oriented, and handling costs may be incurred to the customer if the repair cost is denied.
If the warranty for a defective appliance has expired or if the appliance has not been purchased from DIAS Customs Ltd, and the repair costs do not exceed €45 (including VAT), no prior consent is required from the client for its repair, notwithstanding the current price of the product.
No warranty is provided for repairs regarding water damages.
DIAS Customs Ltd has no liability for any complete or partial loss of personal data during the repair of the appliance. The exclusive liability for saving personal data in any electronic appliance solely burdens the lawful user of the product. Also, DIAS Customs Ltd has no liability for the partial or complete loss of data, which may be due to a defect in the electronic appliance, whether due to a manufacturing fault or a user’s fault.
In case the client does not collect the items brought in for repair within three months, then the company shall not be liable for their safekeeping.
The products of DIAS Customs Ltd are covered by warranty either by the company itself or by the legal representative in Cyprus, or the official representative within the territory of the European Union.
In case of a defect of the appliance, the client is obliged to deliver the appliance to any points of sale of DIAS Customs Ltd.
DIAS Customs Ltd warrants that this product is, at the time of its original purchase, free of defects in manufacturing, materials, design, and workmanship under the above terms and conditions.
1. Duration and Continuity of Warranty
This limited warranty is valid for 24 months, starting from the date of purchase by the client. If the product is replaced during this period, the warranty continues for the remaining duration of the original 24-month term.
2. Warranty Services
During the warranty period, DIAS Customs Ltd, at its discretion, will repair or replace, free of charge, any faulty product. The repaired product or a replacement will be returned to the buyer in operational condition. In case of product repair, the faulty parts will be replaced. The term “accessories or parts” includes all components of the product without exceptions.
3. Warranty Activation and Validity
For the limited warranty to be valid, the buyer must present the original product receipt and deliver the product to any DIAS Customs Ltd store. All products must be in their initial condition, including all accessories and packaging.
4. Exclusions from Warranty
The limited warranty does not cover normal wear and tear and is not valid in cases of:
- Usage contrary to the manufacturer’s instructions, exposure to extreme conditions, non-authorized alterations, misuse, accidents, or actions beyond DIAS Customs Ltd’s reasonable control.
- Failure to notify the company about the defect within 30 days of its occurrence during the warranty period.
- The product not being returned to DIAS Customs Ltd within 30 days of the defect’s occurrence during the warranty period.
- Removal, erasure, alteration, or illegibility of the product serial number or IMEI number.
- Incompatibility with accessories or use of non-authorized parts or software modifications by a non-authorized person.
- Defects caused by files or programs placed on the internal or external memory of the device.
5. Sole and Exclusive Warranty
This limited warranty is the sole and exclusive means of customer satisfaction against DIAS Customs Ltd. It replaces all other warranties and obligations, whether oral, written, by law, contractual, wrongful, or others. DIAS Customs Ltd shall not be responsible for any accidental, incidental, or indirect damage, expenses, or costs.
6. Data Responsibility and Storage
The company assumes no responsibility for any total or partial loss of personal data during the repair of the device. The exclusive responsibility for the safekeeping of personal data in any electronic device lies with the legal user of the product. The company also bears no responsibility for the partial or total loss of data due to a defect of the electronic device, whether caused by a manufacturing mistake (included in the warranty) or a user mistake (excluded from the warranty).
7. Unclaimed Repaired Items
If a customer does not claim the repaired item within three (3) months, the company shall bear no responsibility for its storage.
8. Warranty Coverage for Accessories
All expendables or accessories of a product (e.g., chargers, batteries, headsets) are covered by the good performance warranty for a term no longer than three (6) months, following the requirements stated under paragraph 3.
